KNOW ALL THESE PRESENTS
That I, Thomas A. McIntire of Mount Desert, Hancock County, Maine, in con-
sideration of the sum of one dollar and other valuable considerations, paid by the
Hancock County Trustees of Public Reservations, a corporation organized and existing
under the laws of the State of Maine, and established at Bar Harbor, Hancock
County, Maine, the receipt whereOf I do hereby acknowledge, do hereby REMISE,
RELEASE, BARGAIN, SELL and CONVEY, and forever QUIT-CLAIM unto the said Hancock
County Trustees of Public Reservations and its successors and assigns forever,
a full and free right of way to be used as a foot-way only in and over a certain
strip of land one rod wide, the center line thereof being described as follows:
Beginning at a point south eight degrees thirty minutes west and seventy-
nine feet distant from a stake at shore of Jordan Pond in line of land of said
Hancock County Trustees of Public Reservations; thence south eighty-six degrees
thirty minutes west five hundred and twenty-five feet; thence south fifty-six
degrees west three hundred and two feet to a stake in the center of the town way;
thence south forty-one degrees west five hundred and fifty-nine and six tenths
feet to the western line of land of said Thomas A. McIntire.
And the said Thomas A. McIntire does alsc hereby grant to the said
Hancock County Trustees of Public Reservations its successors and assigns the
right to put and maintain in park like condition the land lying between said
right of way and the adjoining lake shore; and also, for the space of one rod
from the south side of said way, the land upon the opposite side. Said land on
either side of said way to be kept by said McIntire his heirs or assigns free
from buildings or other structures including fencing, with the exception however
of that is necessary for boating purposes or in connection with the gathering of
ice.
The above conveyance is made subject to the rights of Edwin C. Jordan,
under and by virtue of a lease for eleven years from October first, 1919, given
by said McIntire, and also subject to the rights of the Seal Harbor Water Supply
Company under and by virtue of an indenture between George L. Stebbins, said
Water Supply Company and said MeIntire, dated November 19, 1910 and recorded in
the Hancock County Registry of Deeds in Vol. 475, Page 472.
TO HAVE AND TO HOLD the same, together with all the privileges and
appurtenances thereunto belonging, to it the said Hancock County pit steen of
Public Reservations, and its successors and assigns, forever.
AND I do covenant with the seid Hancoak County Trustees of Public
Reservations, and its successors and assigns, that I will WARRANT AND FOREVER
DEFEND the premises to it the said grantee, and its successors and assigns
forever, against the lawful claims and demanda of all persons claiming by,
through or under no.
IN WITNESS WHEREOF, I, the said Thomas A. No Intire and I,
wife of the said Thomas As No Intiro joining in this deed
as grantor, and refinquishing and conveying my right by descent and all other
rights in the above described promises, have hereunte set our hands and seals
this twenty-second day of November in the year of our Lord one thousand nine
hundred and twenty.
