Dear Mr. Opdycke:
Your favor enclosing deed from Mr. How to the Villigge
Improvement Association is received. Wehave a copy on file of the
deed from the V. I. A. to the Trustees of Public Reservations but
have not the original deed.

presented the following resolution and upon
motion it was unanimously adopted, to wit:
WHEREAS this corporation owns a certain lot of land situated
near Hulls Cove in the town of Eden containing thirty-six acres more
or less, being the same conveyed to it by Charles T. How by deed dated
September 24, 1906 and recorded September 25, 1906 in the Hancock
County vaine Registry of Deeds, Book 432, Page 473, and
WHERE'AS this corporation does not desire to abandon the premises
but deems it better that the legal title thereto be transferred to and
held by the Hancock County Trustees of Public Reservations, a corpora-
tion which may more appropriately hold the title thereto;
NOW THEREFORE BE IT RESOLVED that the president and treasurer
of this corporation be authorized and empowered and they are hereby
authorized and empowered to make, execute and deliver a good and
sufficient deed, conveying said property to the said Hancock County
Trustees of Public Reservations without the payment of any considera-
tion therefor.
PROVIDED HOWEVER and such deed shall provide that this corpora-
perpetual
tion shall have the, right to enter upon said land at any time for the
purpose of beautifying the same and making improvements thereon con-
sistent with its use as 3, public park: and
PROVIDED further that said conveyance shall contain conditions
substantially in the following form: This conveyance is made expressly
subject to the following conditions (not conditions subsequent) to wit:
if the said Hancock County Trustees of Public Reservations shall at any
time be dissolved as a corporation or if it shall desire to abandon
the premises, the same shall be conveyed by appropriate instrument to
the inhabitants of the Town of Eden ( a municipal corporation) to be
held by such municipal corporation as a public park. By acceptance
of this deed the said Hancock County Trustees of Public Reservations
agrees to the above conditions and covenants that it will execute all
such instruments as may be or become necessary to carry the same into
full effect.

KNOW ALL VEN BY THESE PRESENTS That the Bar Harbor Village
Improvement Association, a corporation duly organized under the laws of
the State of Maine by Special Act of the Legislature approved March
11th, 1891, and established at Bar Harbor, Town of Eden, Hancock County
in said State, in consideration of one dollar and other valuable con-
siderations to it paid by the Hancock County Trustees of Public
Reservations, a corporation duly organized under the laws of the State
of Maine by Special ACT of the Legislature approved March 28th, 1903,
and established at said Bar Harbor, the receipt whereof is hereby
acknowledged, doth hereby remise, release, bargain, sell and convey,
and forever quit-claim unto the said Hancock County Trustees of Public
Reservations, its Successors and Assigns forever, a certain lot or
parcel of land situated near Hull's Cove in the Town of Eden and County
of Hancock, containing thirty-six (36) acres, more or less, and bounded
and described as follows: to wit: Beginning on "Long Pond" otherwise
known as "Lake Wood" at Elihu To Hamor's southwest line and following
said line about south fifty-six degrees and twenty-five minutes (56°
25') east through a pine stub spotted standing on a ledge about four
(4) rods from said "Lake Wood" ninety-six (96) rods to a stake that
stands fifteen (15) links north.forty degrees and fifteen minutes
(40° 15') west from an oak spotted on the northwest side; thence south
thirty-seven (37) rods to a stake; thence south eighty-three degrees
and fifteen minutes (330 15') west fifty-one (51) rods to 3. stake;
thence north fifty degrees and fifty minutes (50° 50') west passing
through a large pine within cleven (11) links of said stake eighteen
(18) rods to a stake and pile of stones; thence north sixty-two degrees
and thirty minutes (62° 30') west forty-one (41) rods and nine (3)
links to said "Lake Wood"; thence bounded by said "Lake Wood" to the
point of beginning. Neuning and intending to convey and conveying to
the said Hancock County Trustees of Public Reservations all the land
and all the land covered with water known as "Round Pond" or "Fawn
Pond" contained within the above described lines, but none of the land
covered with water known as said "Lake Wood." The courses given above
are by compass October 5th, 1882. The premises hereby intended to be
conveyed being the same premises conveyed to Charles T. How by deed
from the late Edward Lynan Short bearing date October 21th, 1887, and
recorded in the Registry of Deeds of Hancock County aforesaid at page
forty (40) of book two hundred and twenty-two (222), and thereafter
conveyed to the said Bar Harbor Village Improvement Association by
deed from the said Charles T. How bearing date September 24th, 1906,
and recorded in the said Registry of Deeds at page four hundred and
seventy-three (473) of book four hundred and thirty-two (432).
TO HAVF AND TO 1(OLD the same together with all rights of way
and other easements, privileges and appurtenances thereto belonging, to
the said Hancock County Trustees of Public Reservations, its Successors
and Assigns forever. Reserving however to the grantor its Successors
and Assigns the perpetual right to enter upon the land hereby conveyed
at any time for the purpose of beautifying the same and making improve-
ments thereon consistent with its use a£ C public park.
This conveyance is made expressly subject to the following
conditions (not conditions subsequent), to wit: if the said Hancock
County Trustees of Public Reservations shall at any time be dissolved
as a corporation, or if it shall desire to abandon the premises, the
same shall be conveyed by appropriate instrument to the Inhabitants of
the Town of den (a municipal corporation to be held by such crunicipal
corporation as a public park. By acceptance of this deed the said
Hancock County Trustees of Public reservations agrees to the above
conditions, and covenance that it will execute all such instruments
as may be or become necessary to curry the same into full effect.
And, for the purpose of assenting to this conveyance, the said
Charles T. How (unmarried) doth join therein.

by special Act of the Legislature approved March 11th, 1891), the re-
ceipt whereof I do hereby acknowledge, do hereby remise, release, bar-
gain, sell and convey, and forever quitclaim unto the said BAR HARBOR
VILLAGE IMPROVEMENT ASSOCIATION, its successors and assigns forever, a
certain lot or parcel of land situated near Hull's Cove in the Town of
Eden and County of Hancock, containing thirty-six (36) acres, more or
less, and bounded and described as follows: to wit: Beginning on
"Long Pond" otherwise known as "Lake Wood" at Elihu T. Hanor's south-
west line and following said line about south fifty-six degrees and
twenty-five minutes (56° 25') east through a pine stub spotted standing

to the point of beginning. Meaning and intending to convey and convey-
ing to the said BAR HARBOR VILLAGE IMPROVEMENT ASSOCIATION all the land
and all the land covered with water known as "Round Pond" or "Fawn Pond"
contained within the above described lines, but none of the land covered
with water known as said "Lake Wood." The courses given above are by

conveyed by appropriate instrument to the Inhabitants of the Town of
Eden aforesaid (a municipal corporation) to be held by such municipal
corporation as a public park. By acceptance of this deed the said BAR
HARBOR VILLAGE IMPROVEMENT ASSOCIATION agrees to the above conditions
