William L Austin to Seal Harbor Rry Co.
KNOW ALL MEN BY THESE PRESENTS That I, William L. Austin
of Rosemont, Pennsylvania, in consideration of one dollar
and other valuable considerations paid by the Seal Harbor
Realty Company, a corporation organized and existing under the
laws of the State of Maine and located at Seal Harbor, Town
of Mount Desert, Hancock County, Maine, the receipt whereof I
do hereby acknowledge, do hereby GIVE, GRANT, BARGAIN, SELL AND
CONVEY, unto the said Seal Harbor Realty Company, its successors
and assigns forever, certain and property rights
situated at said Seal Harbor and bounded and described as follows,
to wit:-
All and the same property and property rights described as
conveyed in the deed from Cooksey Realty Company to me the said
William I. Austin dated October 21, 1912 and recorded in the
Hancock County, Maine, Registry of Deeds in Volume 494, Page 206
and described in said deed as follows:-
Beginning in the center of the Sea Cliff Drive, so called,
at a point distant eight and seventy five hundredths feet and
bearing north twenty three degrees thirty six minutes west from
an iron bolt in a bridge-stone over Birch Brook near the southerly
side of said Sea Cliff Drive; thence from the point of beginning
running south twenty three degrees thirty six minutes east twenty
four and six tenths feet to a stone post; thence continuing the
same course, viz:, south twenty three degrees thirty six minutes
east four hundred and thirty one and nine tenths feet to a point
distant eleven and seven tenths feet measuring south forty seven
degrees eleven minutes east from the man hole in the sewer called
man hole No. 3; thence south forty seven degrees eleven minutes
east one hundred and sixty three and four tenths feet to man hole
No. 2 in the same sewer; thence south one degree nine minutes west
one hundred and twenty four and eight tenths feet to can hole No. 1;
thence south fourteen degrees nine minutes west one hundred and
thirty five feet, more or less, to low water mark of the sea;
thence generally westerly and northwesterly, but everywhere
following low water mark of the sea to its intersection with a line
bearing south eleven degrees thirty three minutes west of and
approximately one hundred and thirty feet distant from an iron bolt
in the ledge slightly west of and near the shore path hereinafter
referred to; thence from said point of intersection running north
eleven degrees thirty three minutes wast one hundred and thirty
feet, more or less, to the iron bolt in the le dge above referred
to; thence north eighteen degrees twenty seven minutes west forty
seven and six tenths feet to a stone post; thence same course, viz.,
north eighteen degrees twenty seven minutes west one hundred and
twenty four and five tenths feet to a stone post; thence north
forty one degrees twenty minute west two hundred and thirty one
and one tenth feet to the center of said Sea Cliff Drive near the
eastenn terminus of the Bowland Road, so called; thence north
forty seven degrees forty minutes east, but everywhere following
the center line of the Sea Cliff Drive as now located and used
four hundred and twenty four and seven tenths feet to the point
of beginning; excepting, however, from the parcel above described
so much thereof as lies between the center line of said Sea Cliff
Drive and a line everywhere parallel therewith and one rod distant
southeasterly therefrom extending entirely across the parcel
above described. The area of the land hereby conveyed is six
and forty eight hundredths acres, more or lass.
Together with and as appurtenant to every part of the
premises hereinabove described as conveyed the following
rights, privileges and easements, which are to be used and
enjoyed in common by the grantee herein, Ha heirs and
assigns, the grantor, its successors and assigns, and all
other persons who may be now or hereafter entitled to similar
rights, privileges, and easements, to wit:-
(1) A right of way for all purposes of a way over the
Cooksey system of roads at Seal Harbor, being the following roads
as now constructed and used with their varoos branches, towwit:-
The Sea Cliff Drive, Wharf Road, Rowland Road and Upland
Road and a right of way for all purposes of a foot path over a
strip of land five feet in width on which a foot path is now
constructed and used extending from the loop in the branch of the
Rowland Road westerly to the Sea Cliff Drive.
All of said various roads with their branches and said foot
path are shown on a series of plans numbered 1, to 4 inclusive,
marked "Cooksey Roads at Seal Harbor" and recorded in the
Registry of Deeds for Hancook County in Plan Book No. 3, Pages
5 and 6, to which plans so recorded express reference is hereby
made.
(2) A right of way for all purposes of a way over such
small strip of land, if any, as lies between the southeasterly
side line of the Sea Cliff Drive and the northwesterly boundary
of the parcel hereinablve described as conveyed and between the
side lines of said parcel extended to said Sea Cliff Drive.
(3) A right of way for all purposes of a rough foot path
over the Shore Path, BO called, as now located and used and
extending from the easterly line of the parcel hereinabave des-
cribed as conveyed easterly to the terminus of said path and over
the branch of the same hereinafter described, the whole of said
Shore Path, including that portion of the premises hereby conveyed,
being generally described as follows, the description being of
the approximate center line of the said path as now located and
used, to wit:-
Beginning on the southern hide of the Sea Cliff Drive at
a point opposite the eastern terminus of the Rowland Road;
thence southerly following the line of the foot path now c on-
structed and used to a point near the shore of the ocean at the
west side of Ingram's Point, so called; thence in a generally
easterly direction following the line of the foot path as now
constructed and used along or near the shore of the ocean to the
terminus of the old wood road at Hunter's Beach, so called;
thence northerly following the old wood road leading from the
Sea Cliff Drive to Hunter's Beach to the aforesaid Sea Cliff
Drive; with a similar right of way over a branch rough path
leading from the Sea Cliff Drive at a ppint nearly opposite
the Champlain monument and running in a southerly direction to
connect with the above described path at or near the shore.
The maximum width of the aforesaid right of way shall be
four feet and the right of way shall be of that width through-
out where practicable, but where natural obstacles or conditions
make a less width necessary it shall be reduced accordingly; but
the right of way shall everywhere be of sufficient width for the
reasonable passage of a foot passenger with proper opportunity
of passing.
The aforesaid Shore Path is the same described as granted in
the deed from the Cooksey Realty Company to Amos E. Lawrence
and others by deed of Bebruary 28, 1912, recorded in Hancook County,
Maine, Registry of Deeds, Book 488, Page 192, and rights in said
path are hereby granted expressly subject to all and the same
restrictions, limitations, exceptions, reservations and conditions
set forth in said deed.
(4) the right to enter, connect with and use the sewer
on the premises hereby conveyed and running from the Sea Cliff
Drive to the sea upon payment to the grantor herein of an
entrance fee of fifty dollars.
Expressly excepting and reserving, however, from the
operation of this deed and as appurtenant to all the remaining
land of the grantor (whether owned by it in severality or in common
with others) and as appurtenant to land of all persons to whom
similar rights have been granted and to be used in common
herein
by the grantee, his heirs and assigns, the grantor, its successors
and assigns, and all other persons now or hereafter having similar
rights, the following rights, privileges and easements, to wit:-
(a) The right to use, maintain, repair and replace the
aforesaid sewer now running across the premises with its man holes
and connections.
(b) A right of way for all purposes of a rough foot path
over so much of the shore path above described as is located on
the premises hereinabove described as conveyed, this reservation
of rights in said footpath being in accordance with and subject
to all the restrictions, limitations, exceptions, reservations
and conditions as set forth in the aforesaid deod. from the grantor
herein to Amos E. Lawrence and others establishing the said foot
path, and also, further expressly excepting herefrom all rights
in said shore path above described that have been heretofore
herein
granted by the grantor/to Amos E. Lawrence and others by
deed aforesaid and all rights therein that have been heretofore
granted by deeds of similar tenor to any other persons.
Any and all rights of the public under the Laws of Maine
inson much of the space between high and low water mark as is
included in the description of this deed are also expressly
excepted.
TO HAVE AND TO HOLD the aforegranted and bargained premises
with all the privileges and appurtenances thereof to it the
said Seal Harbor Realty Company, its successors and assigns,
to their use and behoof forever.
AND I do COVENANT with the said grantee, its successors,
and assigns, that I am lawfully seized in fee of the premises;
that they are free of all incumbrances except as above stated;
that I have good right to sell and convey the same to the said
Grantee to hold as foresaid; and that I and my heirs, shall and
will WARRANT AND DEFEND the same to the said grantee, its successors
and assigns forever, against the lawful claims and demands of
all persons, except as above stated.
IN WITNESS WHEREOF, I the said William L. Austin and I,
Mary Austin, wife of the said William L. Austin, joining
in this deed as Grantor, and relinquishing and conveying my right
by descent and all other rights in the above described premises
have hereunto set our hands and seals this fifth
day of

Dear Sir:
I am enclosing herewith deed from you to the Seal
Harbor Realty Company. covering your property in Seal Harbor,
drawn in accordance with the deed to you. This deed should
be signed by you on the line opposite the first seal before
a Notary Public who should affix his seal and also have
attached the certificate of a clerk of a court of record,
showing his authority. The deed should be dated and the
acknowledgment dated. You will notice in the witness clause
I have left blank a space to insert the name of your wife
if you are married. She should sign on the line opposite
the second seal. If you are not married the words in the
witness clause from the red cross to red cross should be e-
rased and the words "being unmarried" should be inserted.
This can be done before the word wife. will you then kindly
forward the deed to the Bar Harbor Banking & Trust Company
to be delivered to me upon the receipt of ten thousand dol-
lars for your account.
