Hamor.
(1) That if within the period of five (5) years from the
date of this contract, a road shall be built and opened from
the Neighborhood Road southward to Rock End Avenue, so connect-
ing with the westerly portion of said Rock End Avenue so as to
form a direct continuous road, of not less than fifteen (15)
feet in width, from the Neighborhood Road to Front Street,
and there shall be granted to this corporation, its successors
and assigns, the unconditional right to excavate for the
purpose, and to lay and perpetually maintain, use, enjoy, re-
pair, and renew its pipe or pipes, aqueducts and fixtures
along such direct and continuous road so as to connect the
water main of this corporation in the Neighborhood Road with
its water main on Front Street at such point, or points, as
this corporation, its successors or assigns may select, and
(2) If within such periof of five (5) years from the date
of this contract there shall be conveyed to this corporation,
its successors and assigns, without cost to it, by good and
sufficient deed, the unconditional right to excavate for the
purpose, and to lay and perpetually maintain, use, enjoy,
repair and renew its pipes, aqueducts and fixtures where the pre-
sent piep of this corporation is laid from Front Street to the

(1) That if within the period of five (5) years from the
date of this contract, a road shall be built and opened from
the Neighborhood Road southward to Rock End Avenue, so connect-
ing with the westerly portion of said Rock End Avenue so as to
form a direct continuous road, of not less than fifteen (15)
feet in width, from the Neighborhood Road to Front Street,
and there shall be granted to this corporation, its successors
and assigns, the unconditional right to excavate for the
purpose, and to lay and perpetually maintain, use, enjoy, re-
pair, and renew its pipe or pipes, aqueducts and fixtures
along such direct and continuous road so as to connect the
water main of this corporation in the Neighborhood Road with
its water main on Front Street at such point, or points, as
this corporation, its successors or assigns may select, and
(2) If within such periof of five (5) years from the date
of this contract there shall be conveyed to this corporation,
its successors and assigns, without cost to it, by good and
sufficient deed, the unconditional right to excavate for the
purpose, and to lay and perpetually maintain, use, enjoy,
repair and renew its pipes, aqueducts and fixtures where the pre-
sent piep of this corporation is laid from Front Street to the

shore of Gilpatrick's Cove just north of Gilpatrick's boat
slip
(3) Then and upon the due observance and performance of
all of the conditions above specified this corporation, its
successors or assigns, but at the co st of said Gilpatricks
shall execute and deliver to such persons as said Gilpatricks
may designate in writing a good and sufficient deed or deeds
releasing to them all rights and easements acquired by this
corporation underthe said above described deed from Samuel No
Gilpatrick to Julia A. Gilpatrick of May 8, 1883, in and to
any and all parts of said tract of land south of Neighborhood
Road as in said proposal described, not releasing, however, but
expressly excepting and reserving
(A) All rights and easements to be granted to this
corporation, its successors and assigns, as hereinabove pro-
vided.
(B) All rights possessed by this corporation, its
successors and assigns, under said deed from Samuel N.
Gilpatrick and Julia A. Gilpatrick to use for any purpose
specified in said deed any public or private way now existing
or hereafter to be built wheresoever the same may be situated
whether on said tract or elsewhere.
(c) All rights possessed by this corporation, its
successors and assigns, to excavate for the purpose and to lay,

shore of Gilpatrick's Cove just north of Gilpatrick's boat

(3) Then and unon the due observance and performance of
all of the conditions above specified this corporation, its
successors or assigns, but at the co st of said Gilpatricks
shall execute and deliver to such persons as said Gilpstricks
may designate in writing R good and sufficient deed or deeds
releasing to them all rights and easements acquired by this
corporation underthe said above described deed from Samuel N.
Gilpatrick to Julia A. Gilpatrick of May 8, 1883, in and to
any and all parts of said tract of land south of Neighborhood
Road as in said proposal described, not releasing, however, but
expressly excepting and reserving
(A) All rights and easemonts to be granted to this
corporation, its successors and assigns, as hereinabove pro-
vided.
(B) All rights possessed by this corporation, its
successors and assigns, under said deed from Samuel N.
Gilp&trick and Julia A. Gilpatrick to use for any purpose
specified in said deed any public or private way now existing
or hereafter to be built wheresoever the same may be situated
whether on said tract or olsewhere.
(c) All rights possessed by this corporation, its
successors and assigns, to excavate for the purpose and to lay,

maintain, repair, renew, use and enjoy its pipes, aqueducts
and fixtures not only along the full length of the road known
as the Arthur Gilpatrick Road but along a production of the
same to the shore.
(D) The right to maintain, repair, renew, use and enjoy
its pipe which now crosses the so called Gilpatrick Field in
a general easterly and westerly direction a short distance north
of Abram Gilpatrick's house until the expiration of one year
after the tender to this corporation, as in the second con-
tract contemplated, by said proposal between the parties here-
to, of the cost of the construction of a trench along the
public road which for part of its way now skirts Gilpatrick's
Cove.
(E) The right to maintain, repair, renew, use and enjoy
all of its pipes, aqueducts and fixtures on said tract south
of the Neighborhood Road other than the pipe referred to in
clause D above where they may lie at the date of the delivery
by this corporation, its successors or assigns, of said deed to
said Gilpatricks for a period of five years after the delivery
of such deed, this corporation agreeing that within said period
of five years it will either abandon its pipes, aqueducts and
fixtures then lying in said tract, other than as in said deed
expressly excepted, or reserved, or will remove the same there-
from, with the understanding and agreement that if the same be
not so removed within such period of five years they shall be

maintain, repair, renew, use and onjoy its pipes, aqueducts
and fixtures not only along the full length of the road known
as the Arthur Gilpatrick Road but along a production of the
same to the shore.
(D) The right to maintain, repair, renew, use and enjoy
its pipe which now crosses the so called Gilpatrick Field in
a general easterly and wasterly direction & short distance north
of Abram Gilpatrick's house until the expiration of one year
after the tender to this corporation, as in the second con-
treet contemplated, by said proposal between the parties here-
to, of the cost of the construction of a tronch along the
public road which for part of its way now skirts Gilpatrick's
Cove.
(E) The right to maintain, repair, renew, use and enjoy
all of its pipes, aqueducts and fixtures on said tract south
of the Neighborhood Road other than the pipe referred to in
clause D above where they may lie at the date of tho delivery
by this corporation, its successors or ssigns, of said deed to
said Gilpatricks for E period of five years after the delivery
of such deed, this corporation agreeing that within said period
of five years it will either a band on its pipes, aqueducts and
fixtures then lying in said tract, other than as in said deed
expressly excepted, or reserved, or will remove the same there-
from, with the understanding and agreement that if the same be
not so removed within such period of five years they shall be

deemed for all purposes to be abandoned.
(4) That no private driveway leading to any building
crossing land of only one owner and not adjoining or connecting
with lands or ways of other owners shallbe deemed as included
in the term private way"as used in this contract.
(5) That said Gilpatricks shall have the right at any time
to change or cause to be changed the location of the private
road now leading across the so called Gilpatricks Field, from
the School House southerly by the Old Gilpatrick Dwelling, and
in case such change shall be made and a new way substituted
in whole or in part therefor, the rights of this corporation,
its successors and assigns, in and to so much of the existing
road as shall not form a part of the road as completed after
such substitution shall ipso facto terminate, provided always
that any such change shall not limit or affect the right of
this corporation, its successors or assigns, perpectually to
use, enjoy, repair, renew and maintain any and all pipes
aqueducts and fixtures which shall then lie in or along said
existing road, or any part thereof
(6) That at the time of the delivery of the deed, or deeds,
in subdivision 3 of this contract contemplated this corpora-
tion, its successors or assigns, will also, but st the cost of
said Gilpatricks, execute and deliver to such persons as said
Gilpatricks may designate in writing a good and sufficient deed,

deemed for all purposes to be abandoned.
(4) That no private driveway leading to any building

tion, its successors or assigns, will also but at the cost of
said Gilpatricks, execute and deliver to such persons as said
Gilpatricks may designate in writing a good and sufficient deed,

named, all rights acquired by this corporation under said deed
of May 8, 1883, from Samuel N. Gilpatrick and Julia A. Gil-
patrick in and to any and all lands at Northeast Harhor which
shall have been conveyed by said Samuel N. Gilpatrick by said
Julia A. Gilpatrick, or by any of their heirs by full covenant
warranty deed, excepting only lands which lie to the northward
of said School House Road and such other lands at Northeast
Harbor as this corporation, its successors or assigns, may
then declare to said Gilpatricks in writing its unwillingness
to release.

described premises situated at said Northeast Harbor in said Town
of Mount Desert, and bounded and described as follows, to wit:-
Beginning on the shore of Gilpetrick's Cove, at an iron bolt
in the line of highwater mark and in the northwesterly side line
of a lot of land conveyed by me, the said grantor, to said Margaret
S. Hubbard, by deed of even date herewith; thence about south
sixty two degrees forty minutes west, following a production of
said northwesterly side line of said lot so conveyed to said Mar-
