KNOW ALL MEN BY THESE PRESENTS, That we, M. L. Allen
and L. Elrie Holmes, both of Mount Desert, Hancock County,
Maine, in consideration of one dollar and other valuable
considerations paid by George B. Dorr, of Bar Harbor,
Hancock County, Maine, the receipt whereof we do hereby
acknowledge, do hereby GIVE, GRANT, BARGAIN, SELL AND CONVEY,
unto the said George B. Dorr, his heirs and assigns forever,
a certain lot or parcel of land situated in said town of
Mount Desert on the eastern side of Somes' Sound (so called)
and being the northern half part of lot numbered eighty nine,
according to the survey and plan of the same made by James
Peters Esq. Surpeyor, said lot of land being bounded on the
north by the homestead formerly of Giles H. Sargent and
being the same premises conveyed to the late Oliver Higgins
by Andrew Haynes by deed dated May 1, 1845 and recorded in
said registry Book 79, Page 191, meaning and intending to
convey all our right title and interest in the above described
premises, excepting a certain part of said lot lying on the
eastern side of the Northeast Harbor road heretofore deeded
by Pembroke Higgins to John W. Somes, Robert I. Grindle,
Andrew J. Whiting and William Fennelly.
The said lot herein described as conveyed is the same
real estate described as conveyed in mortgage by Pembroke
Higgins to Andrew J. hiting by mortgage deed dated April 9,
1888 and recorded in said Registry in Book 225, Page 115,
said mortgage hering been subsequently foreclosed by said
Whiting, also same land described as conveyed in deed from
Samuel K. Whiting, et al to John W. Somes and M. L. Allen
recorded in said Registry in Book 311, Page 424.

by J. W. Somes, to L. E. Holmes, dated March 19, 1897 and
recorded in said Registry in Vol. 312, Page 5 to which deeds
and records thereof express reference is hereby made,
TO HAVE AND TO HOLD the aforegranted and bargained
premises with all the privileges and appurtenances thereof
to him the said George B. Dorr, his heirs and assigns, to
their use and behoof forever.
And We Do COVENANT with the said Grantee, his heirs
and assigns, that we are lawfully seized in fee of the
premises; that they are free of all incumbrances; that we
have good right to sell and convey the same to the said
Grantee to hold as aforesaid; and that we and our heirs,
shall and will WARRANT AND DEFEND the same to the said
Grantee, his heirs and assigns forever, against the lawful
claims and demands of all persons.
IN WITNESS WHEREOF, we the said M. L. Allen and L.
Elrie Holmes, and we, Emma A. Allen, wife of the said M. L.
Allen, and Mary E. Holmes, wife of the said L. Elrie Holmes,
joining in this deed as grantors and relinquishing and
conveying our rights by descent and all other rights in the

County, Maine , (if he may be found in your precinct) to appear before
our Justices of the Supreme Judicial Court, next to be holden in Ellsworth
within and for our County of Hancock, on the Third Tuesday of January
next, then and there in our said Court to answer unto Melville L.Allen
and L. Eleri Holmes of Mount Desert in said County in their petition

ly of a certain lot or parcel of land situated in said town of Mt.Desert,
on the eastern side of Somes Sound, so called, and being the northern
half part of lot numbered eighty nine, according to thr survey and plan
of the same made by Jas. Peters, Esq., surveyor, said lot of land being
bounded on the north by the homestead of Giles H. Sargent and being the
same premises conveyed to the late Oliver Higgins by Andrew Haines by
deed dated May 1st. 1845 and recorded in Hancock Registry of Deeds Book
79 Page 191. Being also the same premises conveyed in mortgage by Pembroke

And that your petitioners aver that they are credibly informed and
believe that Edville G. Abbott of Sullivan, Hancock County, Maine, makes
some claim adverse to your petitioners' said estate. Your petitioners
therefore pray that said Edville G. Abbott may be summoned to show cause
why he should not bring an action to try his alleged title to said pro-

Dear Sirs;-
Your letter of May I0th. came to hand We brought a
petitionas you know against E. G. Abbott to show cause why he should
not bring a suit to try his alleged title in the premises At the Jan-
uary term of court last the court ordered that he bring a suit before
the April term of court or else be forever cut off and debarred from
all right and claim to the property. We were entitled to and received
an execution in January against Abbott for $II.86 for costs and
expenses on our original petition. His counsel, Chas. Wood,has commun
icated with me about this execution and said Abbott would arrange it
and that he Wood would see that it was paid, It has not been paid yet
and I have not pressed it because of what Mr. Wood said to me, Mr.
Abbott did not bring his suit at the April term as ordered by the
court and therefore is shut out and debarred of all right in the pro-
perty according to the decree made in January. This is as the matter
stands. I will write Mr. Wood today and have him pay those costs and
then I will communicate with you further.

half of No. 89, which deed has been prepared from the original
deed from Samuel K. Whiting to J. W. Somes, et al.
Will you please sign this deed, have your wife sign
it and hand it to Mr. Holmes and have he and his wife sign it.
It should then be acknowledged by you before a Notary Public/
Will you then return it to the Bar Harbor Banking and Trust
Company and instruct them to deliver it to me upon the
payment of $5,000.
