We were entitled to and received an execution in January against Abbott for $II.86 for costs and expenses on our original petition. His counsel, Chas. Wood,has commun icated with me about this execution and said Abbott would arrange it and that he Wood would see that it was paid, It has not been paid yet and I have not pressed it because of what Mr. Wood said to me, Mr. Abbott did not bring his suit at the April term as ordered by the court and therefore is shut out and debarred of all right in the pro- perty according to the decree made in January.
