The application for the Registration of a Trade-Mark filed by
XXXX, Oct.22,1915, S.N.90,038, Class 45.
has been examined and passed for publication, in compliance
with section 6 of the act authorizing the Registration of Trade-
Marks, approved February 20, 1905.
The mark will be published in the Official Gazette of
June 19,1917.
Any person who believes he would be damaged by the registra-
tion of this mark may oppose the same by filing notice of oppo-
sition, stating the grounds therefor, in the Patent Office
within thirty days after the publication thereof, which said
notice of opposition shall be verified by the person filing the
same before one of the officers mentioned in section 2 of the
act of February 20, 1905.
If no notice of opposition is filed within said time the
Commissioner may issue a certificate of registration.
Copies of the Trade-Mark portion of the Official Gazette con-
taining the publication of the mark may be obtained as soon as
published at five cents each.

The particular description of goods is Ando timita
in that it fails to clearly scantity the anticles upon which
it is desired to claim use of the mark. Amendment is re-
quired. For the information of the applicant it is stated
that printed books are classified in Class 38, Prints and
publications; blank books, on the other hand, are classified
in Class 37, Paper and stationery. Division is required
and registration is refused.
A search of Class 38 fails to show that the mark
is anticipated.

In organizing today the Sieur de Monte Spring
Company (stock corporation) and Sieur de Monts Arboretum and
Wild Gardena (corporation without stock) there were present
in person a majority of the associates. The time and place
of organization having been fixed and furthernotice waived
the absence of a minority does not affect the legality of the
organisation.
The statute is ailent on the point but our best legal
authorities support this view. We think that there is no
doubt that a majority may under the circumstances act with
full legal effect.
As a matter of extreme caution, however, we would like
to have the records show that those absent were represented.
We accordingly enclose proxies which will you please have
signed and filed with the Clerk.

This is a petition to revive the application of the
Sieur de Monts Spring Company, above identified, which became
abandoned November 5, 1916.
The mark stands refused and the applicant has filed an
argument relative to the ground of refusal. The examiner, however,
is not persuaded that the refusal to register should be withdrawn
in view of the argument.
No formal requirements remain to be complied with. The
petition is not verified.
As the examiner is not aware of any facts not disclosed
by the record, and as the question of reviving this application
is wholly within the discretion of the Commissioner, no recommen-
dation is made.
