Dear Mr Deasy,
It occurs to me that legally speaking some of my land
belongs to the Mt Desert Nurseries, although I am equally its owner
as the owner of the Nurseries' stock. This land, which abuts on
Sols Cliff road for a considerable distance should be given perpetual
right of way over the new road along with my other land.

My Dear Mr. . Dorr:"
In drafting the grant of a life estate in Lot D.
I have taken large liberties as you will observe. Mrs. Markoe may
deem the language imposing the restrictions upon it, too severe.
You may regard the phraseology as unnecessarily blunt. I have tried
to embody your idea in such form as to make the restriction as clear
as possible consistent with brevity, and at the same time practically
enforcible.
I have inserted one provision in reference to the selection of
a referee if the parties can't agree, entirely on my own motion, with-
out any suggestion made by you.
You will probably never have to agree upon a third person to
decide any difference between Mrs. Markoe and yourself, and if the
calling in of an expert should be necessary, you can undoubtedly
easily agree with her as to the person. But, if you cannot agree,
some provision should be made as to the selection of such person, and
it seened to me reasonable to have the selection made by some person
holding an important official position, and I have inserted a clause
providing for such selection by the Chief Justice.

My Dear Mr. Dorr:-
I herewith enclose deeds in the matter of exchange
of land etc., with Mrs. Markoe. I have drafted four instruments, to
wit:
First: - Indenture to be executed by all parties, interested,
establishing, describing and granting rights in the new way and prom
viding restrictions as to the use of the way.
Second:" A deed from yourself to Mrs. Markoe granting Lot F.
subject to restrictions upon the fifty foot strips thereof and also
imposing restrictions upon similar strips of your other land lying
opposite Lot F.
Third:- A deed from Mrs. Markoe to yourself granting Lots
C. and D. , subject to a restriction upon a part of the frontage
upon Lot C. fifty feet in width and also imposing a like restriction
upon a strip fifty feet wide of the frontage of Lot Ei. correspond
ing with the restriction upon Lot C.
Fourth:- A conveyance of a life estate in Lot D. from yourself
to Mrs. Markoe and providing certain restrictions as to the use of Lot
D. by the life tenant.
In order that Mrs. Markoe may understand these deeds, she
should have the plan made by Hill, or a copy of it. Shall I have
Mr. Hill make some blue prints and send to you that you may forward
one to her with the deeds, if they are satisfactory to you?

My dear Mr Deasy,
Thanks for your word about the issue of town meeting and
the action taken at it. I will write to Mrs Markoe about the
matter within the next few days, and I will gladly betof any assist-
ance I can to the town in helping it adjust the matter of the right
of way on a satisfactory basis. I shall write Mrs Markoe, as I
have indeed already told her, that I do not think that a sealed iron
pipe laid deep down along the boundary line where there will be no
building over it and showing no evidence of its existence on the
surface sught to be either prejudicial to the value of the land or
the cause of possible annoyance If rightly laid and carried out to
a
suitable discharge. And that I think it far more important to
her to lay stress upon these two points than to urge a claim for
damages which could in no case be considerable in my judgment, nor
in that of Mr Brown whom I consulted with regard to it when he was
at Bar Harbor and who has had a very wide experience here in ad-
justments of that nature. In his judgment as in mine the whole
question of the injury hangs upon the way the work is done.

Dear Mr D.,
I write to give you assurance with regard to Lot C, which you
are acquiring for me under the terms of Mr Ogden's opinion of
September 24th, 1907, with regard to our exchange of land etc., that
I shall not let its value nor the beauty and pleasantness of the
outlook from any portion of it important to that value be lessened
by buildings or other structures erected or by trees retained on
any portion of Lot D lying below Lot C or in its line of view, nor
by allowing any cause of obvious disfigurement to similarly remain
upon it to the injury of Lot C. In case we, or your successor in
ownership and myself, should not at any time agree as to what con-
stitutes such injury I will then unite with you or your successor
in calling in professionally, at our joint expense, such landscape
gardener, architect or other person of knowledge in such matters
as we may agree upon, to give us his opinion on the matter which
shall then be taken as our guide and acted on.

Description of a tract of land situated in Town of Eden, Hancock
County, State of Maine, deeded by Anne Pierrepont Luquer to George B.
Dorr, described as follows:
Beginning at the corner of land of Harvard University, and Anne
Pierrepont Luquer on line of land of George B. Dorr, marked by stone
post and iron bolt, thence N. 21° 15' E. ( old course N. 19° 30' E.) four
hundred and forty seven (447) feet, following boundary line between said
Dorr and Luquer to a stone post set in the ground on said line and at
southerly easterly line of right of way granted by C. H. Dorr to Lucy
Ellis, thence on same course fifteen (15) feet to center line of said
right of way, thence S. 24° 30' E. along center line of right of way
granted by Lucy Ellis to Matilda C. Markoe, twenty-two and 3/10 (22.3)
feet to a point sixteen and 5/10 (16.5) feet distant from last mentioned
stone post, and at right angle to said Dorr and Luquer line, thence S.
21° 15' W. ninety-nine and 4/10 (99.4) feet along center line of said
last-mentioned right of way to a point sixteen and 5/10 (16.5) feet
distant from a stone post set in the ground, and at right angle to said
Dorr and Luquer line, thence S. 5° 30' E. eighty-one and 2/10 (81.2) feet
along center line of said right of way to a point sixteen and 5/10 (16.5)
feet distant from and at right angle to last described line to a stone
post set in the ground, thence S. 20° 40' E. seventy-seven and 8/10
(77.8) feet along the center line of said right of way to a point sixteen
and 5/10 (16.5) feet distant from and at right angle to the last above
described line to a stone post set in the ground, thence S. 03° 55' W.

one hundred and eight and 5/10 (108.5) feet along the center line of
said right of way to a point sixteen and 5/10 (16.5) feet distant from,
and at right angle to the last described line, to a stone post set in
the ground, thence S. 02° 45' E. fifty-four and 3/10 (54.3) feet along
the center line of said right of way to intersection with boundary line
between said Harvard University land and land of Anne Pierrepont Luquer,
thence S. 87° 15' W. ( old course S. 85° 30' W. ) sixteen and 5/10
(16.5) feet to a stone post set in the ground on said boundary line for
the western boundary of said right of way, thence on same course S. 87°
15' W. one hundred and fifty three (153) feet to place of beginning,
containing 29,059 sq. feet, more or less.
