Perlinsky, Kaufman, and Mourkas Contract, March 16, 1935
THIS INDENTURE made this fourteenth day of November,
A.D. 1934, by and between MARK PERLINSKY, of Bar Harbor,
County of Hancock, State of Maine, hereinafter referred
to as the Lessor, and ANGELA C. KAUFMAN, of New York, County
of New York, and State of New York, and THOMAS MOURKAS, of
Bangor, County of Penobscot, State of Maine, hereinafter re-
ferred to as the Lessees, WITNESSETH:
That the Lessor for himself, his heirs, executors, ad-
ministrators and assigns, for and in consideration of the
covenants and agreements hereinafter mentioned to be kept
and performed by the Lessees, jointly and severally, has de-
mised and leased to the Lessees, their heirs, executors, and
administrators; A certain lot or parcel of land, with the
building thereon, known as the PERLINSKY BLOCK, and situated
on the western side of Main Street in said Bar Harbor, and
bounded on the east by Main Street; on the south by the West
End Drug Company; on the west by the Rodick Realty Company,
or a right of way; and on the north by the Harmon Piano Com-
pany.
Said premises are to be used for restaurant and hotel purposes
only.
TO HAVE AND TO HOLD the same for ten (10) years, from
the first day of April, A.D. 1935, until the first day of April,
A.D. 1945; and the said Lessees in consideration of said demise,
covenant and agree with the Lessor as follows, to wit, to pay
as rent for said premises, the sum of Twenty-Eight Thousand
Dollars $28,000), upon the terms and conditions following,
viz: Two Hundred Thirty-Three Dollars and Thirty-Three and
One-Thirds Cents ($233.33-1/3) on the 1st day of April, A.D.
1935, and Two Hundred Thirty-Three Dollars and Thirty-Three
and One-Third Cents ($233.33-1/3 on the 1st day of each and
every month thereafter during the term of said Lease, to and
including the 1st day of March, A.D. 1945, or until the full
sum of Twenty-Eight Thousand Dollars ($28,000) has been paid.

It is understood and agreed that the Lessees know the
condition of said above described premises, and hold the said
Lessor harmless by reason of any latent defect in the same.
The Lessor, however, agrees to keep the outside of the build-
ing in good tenantable order and repair during the whole term
of the Lease. The Lessor, however, shall not be liable for
any damage done or occasioned by or from Plumbing, gas, water,
steam, or other pipes or sewerage, or the bursting, breaking,
leaking, or running of any tank, washstand, water closet, or
waste pipe, in, above, upon, or about said building or prem-
ises, nor for any damage occasioned by water, snow, or ice be-
ing upon or coming thru the roof, sky-light, trap-door, or other-
wise, nor for any damages arising from acts or neglect of co-tenants
or other occupants of the same building, or of any owners or OC-
cupants of adjacent or contiguous property.
And the said Lessor agrees with the said Lessees that the
said Lessees may renovate and remodel said building as they shall
see fit, but at their own expense; provided, however, that in so
doing, they shall in no way weaken the structure of said build-
ing. It is further agreed on the part of said Lessees that they
will make all repairs in accordance with the Town Ordinances,
and under the direction of the proper Town officials.
And the Lessor may enter to view the premises and to ex-
pel the Lessees if they shall fail to pay the rent aforesaid,
whether said rent be demanded or not, or if the said Lessees
shall make or suffer any strip or waste thereof, or shall fail
to quit and surrender the premises to the Lessor at the end of
