KNOW ALL MEN BY THESE PRESENTS, THAT I, Frank A. Dillingham
of Millburn, Essex County, New Jersey 9 in consideration of
one dollar and other valuable considerations paid by George
B. Dorr of Bar Harbor, Hancock County, Maine, the receipt
whereof I do hereby acknowledge, do hereby GIVE, GRANT,
BARGAIN, SELL AND CONVEY, unto the said George B. Dorr, his
Heirs and Assigns forever, one undivided half part of a
certain lot or parcel of land situated in Bar Harbor, Hancock
County, Maine, and bounded and described as follows, to wit:-
Beginning at a stake six feet southerly from an Oak
tree spotted on the South side and an H marked on said spot
and runs from said stake South eighty two degrees and ten
minutes East twenty four rods to a Birch tree spotted on
the West and South sides; thence South deven degrees and
fifty minutes West twenty five rods and seventeen links to
a pile of stones on a ledge six feet Northerly from a
Cedar tree spotted on the North sides; thence North eighty
two degrees and ten minutes West twenty four rods to a
Birch tree spotted on the East and North sides; thence North
seven degrees and fifty minutes East twenty five rods and
seventeen links to the first mentioned bound & contains three
acres, and one hundred and thirty six rods, together with
a right of way from said lot to the road known as the Break
Neck road courses by compass as of October 12, 1882.
TO HAVE AND TO HOLD the aforegranted, and bargained
premises with all the privileges and appurtenances thereof
to him the acid George B. Dones His Heirs and assigns, to
their use and behoof forever.

I am of legal age and a son of George W. Dillingham,
formerly of Summit, New Jersey, one of the grantees in deed
from Daniel W. Brewer to George W. Dillingham, and William
M. Roberts of 1882.
Said George W. Dillingham died intestate, a resident
of Summit, New Jersey, in December, 1895, leaving him sur-
viving his widow, Helena W. Dillingham, his daughters, Lucy
Dillingham and Helena Dillinghanj, and myself, being his only
heirs at law.

In accordance with Miss Adams' letter of May 23rd
I am enclosing herewith a rough pencil sketch showing the lands in
the vicinity of the pig farm and Half Moon Pond.
No. 1. is Half Moon Pond
No. 2. is the Snow Lot containing 34 acres for which
we paid $2,500.
No. 3. is the Morrison-Jones lot containing 50 acres
for which we paid $2500.
No. 4. is the Bunker lot containing 1 1/3 acres for
which we paid $100.
No. 5. is the Roberts lot containing 10 acres which
cost $500.
No. 6. is the Brewer Realty Lotcontaining about
400 acres for which we paid $17,500.
No. 7. is the Hagerthy & Spratt lot containing
-20 acres for which we paid $425.
No. 8. is the Cunningham Lot containing acro s
for which we paid $1300.
No. 9. is the Rodick Realty Company lot conta ning
140 acres, about.
The price on this last lot was included in the
purchase of the Ash Mountain lot on the Eastern side of Green Mountain

and I have no way of fixing the cost per acre of Lot No. 9.
According to the plan Lot No. 9 would contain
more than 140 acres but the lines ABC should be carried farther
to the East.

one-half of the Half Moon Pond Lot.

I feel confident that he has had no reply to his inquiry. How
ever, I shall see him on Monday morning - he is not in his
office today - and if there is anything new will write you again
at once.

With reference to the tract of land in this town known
as the Half Moon Pond Lot title to which I have been
examining for Mr. Rockefeller's interests, deed to run
to Mr. George B. Dorr, I find that Daniel W. Brewer in 1882
conveyed the property to George W. Dillingham and William
M. Roberts. I find no deed from George W. Dillingham and
no probate of his estate in this jurisdiction, but I do
find that Helena W. dillingham, Lucy Dillingham and Helena
Dillingham conveyed the property to you in 1897.
Under the law in this state intestate property passes
to the heirs of the deceased subject to the possible claims
of creditors. In 1897 an act was passed barring all claims
of creditors after six years where no administration is
had upon the estate within six years from the date of the
death of the decedent and no petition for administration
is pending.
I assume that Mr. Dillingham died prior to 1897 an d
that Helena W. Dillingham, Lucy Dillinghan, Helena
Dillingham and yourself are the only heirs.
I wrote Mr. Thomas M. Debevoise with reference to the
matter and he gave me your address suggesting that I write
to you regarding the matter.

What I would like to have to accompany the deed,
when delivered, is an affidavit from you setting forth
the date of the death of George W. Dillingham, that he
died intestate and the name of hi3 wife and his children,
in which case if the above parties are his only heirs,
no probate of the estate is now necessary.

Dear Mr. Debevoise:
I have today written to Mr. Dillingham with reference
to the affidavit referred to in your recent letter.
Some time ago Mr. T. L. Roberts, Real Estate Agent,
advised me that the Half Moon Pond Lot which was owned
one-half by Mr. William M. Roberts and one-half by Mr.
Dillingham was for sale at $1,000. We concidered the
price too high and offored him $750. which was refised.
Later Mr. Rockefeller told me that Mr. Dullingham was
willing to accept $250. for his portion although Mr.
Roberts was to receive $500.
A short time ago, acting upon that assumption although
nothing was said to Mr. Roberts with reference to the
amount Mr. Dillingham was to receive, I prepared two deeds,
one from Mr. Roberts and the other from Mr. Dillingham.
Mr. Roberts has not as yet signed his deed and Mr. Dillingham
is waiting, I believe, until his wifes return.
At about the same time I told Mr. Roberts that I was
anxious to get the price of the lot down in order not to
fix a high basis for other lands in the vicinity in case
we wanted them. He replied that the price of this lot was
$1,000.

Dillingham has stated that he was willing to accept $250.
making the price $750.. should say that the price of the
lot was $1,000. instead of $750.

Dear Mr. Debevoise:
We are endeavoring to purchase a lot in the town of
Bar Harbor containing a little over three acres known as
the Half Moon Pond Lot, conveyed by Daniel W. Brewer to
Geo. W. Dillingham and William M. Roberts. Our negotiations
have been through Mr. T. L. Roberts, Real Estate Agent.
I prepared an abstract of title in 1922 of this lot.
At that time I found no deed from Geo. W. Dillingham and no
probate of his estate but in 1897 Helena W. Dillingham,
Lucy Dillingham and Helena Dillinghan conveyed the property
with other lands to Frank A. Dillingham. It is possible
that the grantors had a deed from Geo. W. Dillingham or
it may be that he has deceased and they are his heirs.
In 1917 an act was passed, Sec. 13 of Chap. 134, barring
all claims of creditors after six years. The Section is
as follows: 17 Where no administration is had upon the estate
of a deceased person within six years from the date of death
of said decedent and no petition for administration is
pending, all actions upon any claims against said decedent
shall be barred."

Mr. Rockefeller tells me you know the family and
could give me what information I need.
If the above parties were the heirs of Mr. Dillingham
he having died prior to 1897, I can see no necessity
of having the estate probated here.

Dillingham conveyed all their interest in the property to
Frank A. Dillingham of Summit, New Jersey. I did not find
any probate of the estate of George W. Dillingham. I
assumed however that he must have deceased and the heirs
conveyed to Frank A. Dillingham.

Dear Mr Heydt:
I have today seen Mr. T. L. Roberts who is a Real Estate
agent and is acting for Mr. W. M. Roberts in the sale of the
Half Moon Pond Lot. He tells me that Mr. Roberts feels that he
can get $500. for his half and of course that influences the
owner of the other half, so that the property cannot at the
present time be bought for less than $1,000. The deed recites the
lot as containing 3 acres and 136 rods with a right of way to the
Breakneck Road. The acreage mayinclude the water as well as the
land. We paid $50. an acre for the Mildred Morrison or Jones
Lot which is a short distance from this, $71. an acre for the
Snow Lot, both these lots bordering on the Breakneck Road. I do
not believe anyone will pay $1,000. for the lot. Eventually I
think you will need it if you continue the horse road toward Hulls
Cove but it seems to me that it could be bought as well later as
now and at a price as satisfactory. of course there is a possi-
bility of their raising their price, but I cannot imagine anyone
other then you having any interest in acquiring the lot.
I talked with Mr. Ralston about this and he feels the same way.
The Lot probably should be acquired before it becomes known that
any road will go through or near it.
The other owner at the time I examined the property in 1922
was Frank A. Dillingham of New York.

It is, as you say, desirable not to set high prices for
property in this vicinity because of the pieces which we have
not yet bought owned by the man who bought them to raise pigs upon,
the price for which was according to my recollection, much less
than is now being asked for the Half Moon Lot.

Dear Mr. Rockefeller:
The Half Moon property is owned by Mr. Roberts. I have been
to him, discussed the matter and felt it wise to offer him the
$750.00 which I did. He is considering the matter and is to
advise me later.
The Pest House lot is owned by the Town of Bar Harbor. At
the last town meeting the town authorized the selectmen to sell it.
There are a number of people who want to buy it. The selectmen
feel that the interests of the town would be best served by letting
me have it. They feel however that as officers of the town they
should sell it for the highest fair price they can get, not allowing
any holdups. I. am quite sure that the property will bring more
than five hundred dollars.
There is a building upon it that may be the means of bringing
the price up. It is possible that we could buy the land and
let the town sell the building to someone else to be removed
at once.

Dear Mr. Lynam:
Your letter of March 24th is received, also the colored
map of which you kindly sent me a copy. I think it is desirable
that I should buy both the Pest House property and Half Moon Pond
and the property surrounding it, owned by Mr. Roberts. I author-
ize you to buy these two pieces at the best prices you can obtain,
assuming that the Pest House will not be much above $500, if any,
and the Roberts land can probably be bought for something less than
$1,000. This latter property is quite inaccessible and will have
little if any market value. Therefore I should think an offer
of perhaps $600 or $750. might buy it. Again, it is desirable
not to set high prices for property in this vicinity, for there
is still the pieces owned by the man who bought it to raise pigs
on which we have not yet bought.
I am leaving for New York on Thursday of this week,
and hope to go to Maine the latter part of April as usual.

Dear Mr. Heydt:
I have concluded the purchase of the Pest House Lot taking
the deed in Mr. Dorr's name as usual. This deed has been recorded
in Volum 608, Page 564 of the Registry of Deeds for this county,
Mr. Dorr has executed a deed running to Mr. Rockefeller which

Dear Mr. Rockefeller:
Mr. Dorr for use in Washington, got us to prepare a chart
showing the Reservations lands and the Park lands shown in
pink and yellow. We have taken a copy of the plan, which I
am forwarding you under separate cover, and added in green,
the land you have purchased.
At the last annual town meeting the town voted to sell the
Pest House for not less that the amount it was inventoried for,
which I understand was $500.00. They may be able to get more
than $500.00 for it. It is North of the Eagle Lake Road just
opposite Mr. Rich's Camp containing 1/2 acre with a right of way
to the Eagle Lake Road. It is shown in Black on the plan referred
to. You own land all around it and I should think it important
that you have this piece. It has a fairly good building upon
it,
Mr. T. L. Roberts spoke to Mr. Hill and also to me stating
that the Half Moon Pond, the land surrounding it and the right
of way to the Break Neck Road is now for sale. It is owned by Mr.
W. M. Roberts and by a man by the name of Dillingham who lives
in New York. I understand there is about three acres. They want
$1,000.00. Any road in this section connecting with the horse road
will probably either touch or go very close to this lot. You will

Dear Mr. Rockefeller:
I am enclosing herewith notice of sale of the Pest House
Lot by the selectmen of the Town asking that bids be filed not
later than 5 P. M. April 14th.
I wrote you on April 6th suggesting that it might be advis-
able to purchase the land and allow others to purchase the
building and move it. The building could be torn down and moved
but not moved otherwise.

I yesterday morning went over to Seal Harbor and consulted
Mr. Ralston with reference to the Pest House Lot. I told him that
the Chairman of the Board of Municipal Officers told me there were
three people interested in the property in fact the chairman went
to the property with one of them.
Mr. Ralston thought we should make an offer 6f $650. but after
a full discussion it was left that I was to see what I could learn
here and then make the offer between $600. and $650.
I again discussed the matter with the Chairman of the Board a d.
he frankly stated that he wanted us to have the property and advised
me to offer $650. I therefore made the offer at $650.
No other bids were put in. Just why I am at a loss to know.
The bid was therefore accepted.
Will you therefore have your office forward me check for the
amount $650.00 that I may close the transaction.

Your letters of April 6th and 8th are received. I note
you have offered Roberts $750 for his land, and that you think the
Pest House property will bring more than $500. Your idea of sel-
ling the house and moving it off seems to me a good one, but your
second letter indicates that this is impossible, I presume either
because it is too old to move or it would cost too much to move it.
The house would bring very little if torn down.
It seems to me desirable that we should buy this property.

accomplish that end, and authorize you to make the purchase on the
best terms possible.
Mr. Ralston may be able to be helpful to
you in conference if you care to talk with him about the matter.

you are holding.
3. Deed from Frank A. Dillingham to George B. Dorr
dated September 12, 1927 and recorded September 21,
1927, in volume 614, Page 332.
4. Also copy of deed to Mr. Rockefeller from George
B. Dorr covering the above lot, the original of which
you are holding.
5. Affidavit made and signed by Frank A. Dillingham
to the effect that George W. Dillingham died intestate.
The deeds above referred to each convey a half interest
in the Half Moon Pond Lot.
